Article 4 of the Convention on the Rights of the Child obliges States parties to “undertake all appropriate legislative, administrative and other measures for the implementation of the rights recognized in the present Convention”. Independent National Human Rights Institutions (NHRI’s) are an important mechanism to promote and ensure the implementation of the Convention on the Right of the Child (CRC). The Committee on the Rights of the Child (the Committee) considers the establishment of such bodies to fall within the commitment made by States parties upon ratification to ensure the implementation of the Convention and advance the universal realization of children’s rights.

In its General Comment No. 21, the Committee describes the role and characteristics of independent human rights institutions for children. The Committee encourages States parties to establish specialist independent human rights institutions with the aim to promote and protect rights of the children.

Realizing its commitment under CRC, the State of Pakistan has established a National Commission on the Rights of Child (NCRC) through the Act XXXII of 2017. The preamble of the Act says; “WHEREAS it is expedient to set up a National Commission on the rights of the child in accordance with international obligations and for matters connected therewith or incidental thereof.”

The National Commission on the Rights of Child Act, 2017 stipulates a broad and overarching mandate for the promotion, protection and fulfilment of child rights as enshrined in Constitution of Pakistan and international treaties particularly CRC. As a State watchdog, the NCRC works independent of the Government and is accountable to the Parliament of Pakistan. The primary functions and powers of the NCRC include, among others, to conduct inquiries into allegations of child rights abuse(s); review existing and proposed legislation from child rights perspective; carry out research and advise on policy matters pertaining to the situation of child rights in Pakistan; contribute awareness-raising and advocacy initiatives and suggest measures to follow up on the implementation of concluding observation of the Committee. The Commission became operational in February 2020, with the appointment of the Chairperson and its Members. 

The Commission requires the services of a qualified full time Legal Advisor in execution of business related to legal matters.

The Legal Advisor is responsible to perform following tasks;

  • Examine and review existing, proposed and any law or policy or practice, for the time being in force, for protection of child rights and recommend measures for their effective implementation;
  • Legislative review of federal and provincial child protection laws;
  • Draft working papers and response on legal matters and represent the NCRC in various forums including Standing/Special Committees of the Senate, National Assembly, Law ReformsParliamentary Committees and all other forums on legislative matters;
  • Examine international instruments, concluding observations and recommendations of treaty bodies and undertake periodical review of existing policies and programs on children issues and prepare policy recommendations for their effective implementation in the best interest of children;  
  • Assist the NCRC in inquiring and responding into alleged violation of child rights particularly right of a child to protection from violence, abuse, exploitation, neglect and harmful traditional practices such as child marriages; and recommending to the relevant agency or department for initiation of proceedings in such cases;
  • Design templates for hearing notices, summons, decisions etc;
  • Incorporation of amendments/observations in the recruitment, financial, medical and other rules proposed by the relevant quarters, complaint handling and any other rules as assigned by the Chairperson NCRC; and
  • Render legal opinion and deal with all legal matters of NCRC as required.

National Commission for Human Development (NCHD) was established in July, 2002 as a federal statutory body. It is a fast-track initiative to improve social sector outcomes at the grass-roots. With a ranking of 144 on the UNDP�s Human Development Index, out of a total of 178 countries, Pakistan faces enormous challenges at the beginning of the new millennium. Poverty, illiteracy, lack of health care facilities and a continuously soaring population have for long hampered the scope of generating improved social sector outcomes for the millions of Pakistanis living at the grassroots. Attempts made in the past to address these issues have often been marred by the lack of political will, economic & political instability and inadequate capacity of the implementing agencies which further exasperated the already dismal state of human development in the country. A Task Force on Human Development was established in June 2001. It was designed to find innovative solutions to improve and fill implementation gaps in social service delivery at the grassroots in the sector of Education, Health and Poverty Alleviation.
